Under the Work Health and Safety Act 2011 (the Act) a person conducting a business or undertaking has a primary duty of care to ensure, so far as is reasonably practicable, that the health and safety of its workers and other persons are not put at risk from work carried out as part of the conduct of the business or undertaking.

​

An officer of the person conducting the business or undertaking must exercise due diligence to ensure that the person conducting the business or undertaking complies with that obligation.

​

Section 27 of the Act prescribes the requirements of “due diligence” as being:

​

(a) to understand the business and the hazards and risks associated with it;
(b) to ensure the person conducting the business or undertaking has processes for receiving and considering information regarding incidents, hazards and risks and responds in a timely way; and
(c) ongoing verification.

The Duty to Manage Asbestos
 

The Work Health and Safety Regulation 2011 requires that a person with management or control of a workplace must ensure that an asbestos register is prepared and kept at the workplace. This means that it is law that all buildings built prior to 1990 have an asbestos register prepared and maintained.  This is irrespective of whether asbestos is assumed to be present or not.

All PCBU’s have a duty to identify, record and manage asbestos contained within their premises. 

​

This duty requires the elimination of risks to health and safety so far as is reasonably practicable and, if elimination is not reasonably practicable, the risks must be minimised so far as is reasonably practicable.

Asbestos Assessors & Clearance Inspections
 

Buildings or workplace that have had asbestos removed by licensed asbestos removalists must be assessed or cleared to determine if they are safe for re-occupation/demoltion. Asbestos Clearance inspections should be conducted by a licensed assessor.

 

Protec Consulting provide Asbestos Clearance inspections for Class A or Class B asbestos removal work through our Workcover approved Licensed asbestos assessors. 

 

A valid clearance certificate should be obtained prior to reoccupation. If this is not obtained the asbestos removal area is not to be reoccupied for normal use or any other activity.  The clearance certificate must be issued before the area can be reoccupied.
